Effective Jan. 1, 2023, inspectors and roadside enforcement personnel in Canadian provinces and territories may begin documenting electronic logging device violations and issuing citations to commercial motor vehicle drivers operating vehicles without a Canadian-compliant ELD.
Rules requiring electronic logging devices in Canada officially came into effect June 12 of 2022, but most provinces and territories were not prepared to begin enforcement at that time. Instead, they implemented a period of “education and awareness” that saw roadside inspectors advising drivers on the need to comply as of Jan. 1, 2023. As of the first of the year, fleets operating in Canada must have installed and activated one of the Transport Canada-approved devices, even if the fleet is based in the U.S.
However, as the Commercial Vehicle Safety Alliance notes, each Canadian province and territory has jurisdictional regulations for applying the ELD rule to its regulated carriers. CVSA recommends that drivers and motor carriers check with each Canadian province and/or territory they may travel in or through to verify each jurisdiction’s requirements.
The provincial trucking associations that form the Canadian Trucking Alliance have compiled a chart that explains what to expect in each jurisdiction as of January 1.
The ELD mandate does not change any of Canada’s underlying hours-of-service requirements.
